TERMS AND CONDITIONS

OF THE ONLINE STORE OPERATED ON THE WEBSITE www.ewodd.com.

The entity authorized and responsible for all matters related to the operation of the online store on the website www.ewodd.com, hereinafter referred to as the Store, as well as distance sales conducted as part of business activities, is HandCraft Polska Sp. z o.o., with its registered office in Stary Sącz, at ul. Węgierska 12 b, entered in the register of entrepreneurs of the National Court Register under KRS number 0000276567; holding NIP 7343221135; REGON 120422171; with share capital of 100,000 PLN, phone number +48 727-444-009, e-mail: info@ewodd.com, hereinafter referred to as the Seller.

The content of these Terms and Conditions is intended for consumers making purchases through the Store, hereinafter referred to as the Customer.

1. PRELIMINARY PROVISIONS

    1. These Terms and Conditions regulate all matters related to distance sales conducted in the online store www.ewodd.com, within the meaning of the Act of May 30, 2014 on Consumer Rights as of January 28, 2020 (Journal of Laws of 2020, item 287) and the Act of April 23, 1964, the Civil Code as of August 2, 2023 (Journal of Laws of 2023, item 1610).
    2. A condition for the provision of services specified in the Terms and Conditions is to read and accept all provisions of these Terms and Conditions.
    3. To use the Store, including browsing the Store’s assortment and placing orders for products, the following are required:
      1. a computer with Internet access and a web browser such as Internet Explorer, Google Chrome, Mozilla Firefox, Opera, Safari;
      2. an active email account.
    4. The website www.ewodd.com and its content are the property of the Seller and are legally protected.

2. PRODUCT INFORMATION

    1. EWODD brand products available in the Store’s assortment are non-prefabricated products, manufactured according to the Customer’s specifications and serve to meet their individualized needs, within the meaning of the Act of May 30, 2014 on Consumer Rights as of January 28, 2020 (Journal of Laws of 2020, item 287) and the Act of April 23, 1964, the Civil Code as of August 2, 2023 (Journal of Laws of 2023, item 1610).
    2. The product offered on the Seller’s website is furniture that the Customer configures independently, within the available options placed in the store on the website www.ewodd.com.
    3. In its offer, the Seller does not have ready-made EWODD brand furniture; all are made to the Customer’s order. The furniture presentations on the Seller’s website are only project suggestions. If the Customer orders a project proposed on the Seller’s website without making any changes, it will be their individual configuration.
    4. All furniture purchased in the Store is intended for self-assembly.
    5. In its offer, the Seller has ready-made furniture in the “IN STOCK” section and ready-made furniture of brands other than EWODD.
    6. All products available in the Store are brand new, free from physical and legal defects, and have been legally introduced to the Polish market.
    7. All prices listed on the Seller’s website are in Polish zloty and include value-added tax at the rate specified by applicable regulations.
    8. Product prices on the Seller’s website are determined when selecting configuration options in the store. The product price depends on the Customer’s choice of product parameters such as size, materials, color, and other additional options, e.g., handles, finish, etc.
    9. The total product value is displayed on the Seller’s website after adding the product to the cart. The cart may contain several products. The total order value consists of the sum of product values and shipping costs, which are calculated after the Customer clicks “View Cart” or “Order”.
    10. The binding and final price is the sum of all product prices and shipping costs displayed on the Seller’s website after the Customer clicks “Order”. The shipping cost displayed on the Seller’s website applies within Poland.
    11. The order fulfillment times provided on the store’s website refer to business days.
    12. The Customer has the right to make changes to a placed and paid order for EWODD brand furniture by contacting the Customer Service Department via email within 2 business days. In case of configuration changes to a given product after placing an order, the product price as well as the delivery time may change. All configuration changes and price changes must be confirmed by email.
    13. The Customer does not have the right to make changes to a placed and paid order for furniture of brands other than EWODD and products in the “IN STOCK” section.
    14. Additional information about the offered product and services such as assembly, measurement, carrying can be obtained by calling +48 727 444 009 during business hours from 8:00 AM to 5:00 PM on business days, or by writing to the email address: info@ewodd.com.
    15. The Seller reserves the right to make ongoing changes to product prices and to conduct and cancel all types of promotional campaigns and sales. The right referred to in the previous sentence does not affect orders placed before the date of entry into force of the price change, promotional campaign conditions, or sales.

3. PRODUCT ORDERING RULES

  1. Placing orders on the website www.ewodd.com can be done through a registered Customer Account or on a one-time basis, without the need for registration.
  2. To place an order, the Customer must take the following steps:
    • add a ready-made product to the cart or configure furniture on the Seller’s website according to their own preferences within the available options,
    • fill in the Customer’s details including: first and last name, address, phone number, email address,
    • place an order for the product by clicking “Buy and Pay”,
    • make payment for the order.
  3. After placing an order, an order number is generated, which uniquely identifies the order. This number is necessary to make payment for the ordered goods and is helpful in contacts with the Customer Service Department.
  4. The order is processed after the payment for the goods ordered by the Customer has been posted.
  5. After placing an order, the Customer will receive an automatic reply to the provided email address confirming receipt of the order.
  6. The Customer may cancel the order requesting a refund no later than three business days. Order cancellation is possible by contacting the Customer Service Department at the email address: info@ewodd.com.
  7. In the event that some products covered by the Customer’s order are unavailable in production or the selected configuration cannot be executed, the Seller will immediately inform the Customer and refund the paid amount.
  8. The Seller reserves the right to contact the Customer at the phone number or email address provided by them in order to supplement or confirm the data provided in the order form.
  9. In the event that it is not possible to contact the Customer, the Seller reserves the right to leave the order without further action until the Customer supplements the data enabling order fulfillment, but not longer than 14 days from the moment the Customer placed an incomplete order. After the aforementioned period, the Seller has the right to cancel the order.
  10. Orders through the Store can be placed 24 hours a day, 7 days a week throughout the year.
  11. The contract concluded between the Customer and the Seller regarding the purchase of a given product in the Store is of a fixed-term nature and lasts for the duration of order fulfillment. The place of performance of the obligation related to the purchase of products in the Store is the delivery address indicated by the Customer.
  12. Proceeding to use the Store, even without registration, is equivalent to concluding an agreement for the provision of services by electronic means on the terms specified in these Terms and Conditions.
  13. The agreement for the provision of services by electronic means is concluded for an indefinite period.
  14. To create an individual Customer Account, prior Registration is required.
  15. Registration takes place after “proceeding to checkout”, where the Customer fills out a registration form.
  16. The registration form contains fields that must be filled in to create an Account and place orders through it. The Customer provides in particular: first and last name, email address, shipping and/or billing address, password.
  17. The Customer is obliged to provide data in accordance with the truth and bears legal responsibility in this regard. The Seller may make registration or use of the Store by the Customer conditional upon authentication of the Customer’s data listed during registration.
  18. The password is confidential and can be changed by the Customer.
  19. Having an individual Account enables the Customer to place orders without having to provide order fulfillment data each time (in case of a change of delivery address, the Customer has the option to provide multiple addresses), view all orders that have been saved to the Customer’s account (NOTE: after 2 months, the Seller has the right to delete configured and unprocessed orders), review the Customer’s purchase history retrospectively, and monitor the status of placed orders.
  20. After sending the completed registration form to the Seller, the Customer receives a message at the provided email address confirming the creation of the Account, and from that moment the Customer can use the created Account. Conclusion of an agreement for the provision of services by electronic means is equivalent to making statements with the following content:
    1. I am using the Store voluntarily,
    2. I meet the conditions for becoming a Customer as specified in the Terms and Conditions,
    3. The data contained in the registration form is true and does not violate the rights of third parties,
    4. I consent to concluding a contract by electronic means,
    5. I consent to the processing, collection, recording, storage, development, disclosure, and deletion of the Customer’s personal data by the Seller to the extent necessary to provide services by electronic means, in the manner specified in these Terms and Conditions.
  21. An unregistered Customer may terminate the agreement for the provision of services by electronic means at any time with immediate effect.
  22. A registered Customer may terminate the agreement for the provision of services by electronic means at any time. A statement of termination made by a registered Customer should be submitted via email, and the message should be sent from the address provided in the Customer’s Account. The date of submission of the statement of termination is the date of receipt of the email message containing the statement of termination.
  23. The Seller may terminate the agreement for the provision of services by electronic means immediately in relation to a registered Customer if:
    1. The Customer, in case of a change, did not immediately update the data required for registration in the Store,
    2. The Customer posts unlawful content in the Store,
    3. The Customer sends unsolicited commercial information,
    4. The Customer grossly or persistently violates the provisions of the Terms and Conditions or undertakes actions contrary to the purposes and intended use of the Store,
    5. The Customer has not used their account for at least 6 months.
  24. A statement of termination of the agreement for the provision of services by electronic means made by the Seller will be sent to the email address provided in the Customer’s Account.
  25. Termination of the agreement by either party, as well as its termination by mutual consent, is equivalent to blocking the Customer’s access to the Customer Account and its deletion.

4. DELIVERY AND PAYMENTS

  1. The goods ordered by the Customer will be shipped after payment (payment “in advance”).
  2. The Seller accepts the following payment methods:
    1. Bank transfer to company account number: 60 1050 1722 1000 0090 3091 8180. HandCraft Polska Sp. z o.o. ul. Węgierska 12b, 33-340 Stary Sącz.
    2. Transfer via PayPal.
  3. The date of payment is the date the amount is posted to the bank account.
  4. After placing an order, the Seller issues a receipt. If the Customer needs an invoice, they should inform the Seller at the time of placing the order (selection box for individual customer or Company). It is therefore necessary to check the Company box and provide the NIP number when placing the order, because according to the VAT Act of July 4, 2019 – paragraphs 5-7, Article 106b as amended – a receipt confirming the sale must contain the NIP number by which the Customer will be identified for tax purposes. The invoice will be sent to the Customer by email. The Customer consents to the issuance and electronic transmission, to the email address indicated by them, of electronic images of settlement documents, in particular such as: VAT invoices with attachments, corrective VAT invoices with attachments, order forms, and others. This consent also authorizes the Seller to issue and send VAT invoices in electronic form, in accordance with the regulation of the Minister of Finance of December 17, 2010 on sending invoices in electronic form, the rules for their storage, and the procedure for making them available to the tax authority or tax control authority. A receipt or copy of the invoice will be delivered to the customer along with the ordered goods.
  5. Goods of the EWODD brand ordered by the Customer are delivered to the address indicated in the order (to the building entrance), within 14 to 40 business days (in the case of ordering Countertops, the fulfillment time is up to 60 business days) from the moment the payment for the order placed by the Customer is posted. Providing an incomplete or incorrect shipping address may delay or prevent order fulfillment, for which the Seller is not responsible. In exceptional situations, in consultation with the Customer and with their prior consent, the Seller may extend the order execution time by up to 14 business days.
  6. Goods of brands other than EWODD and goods from the “IN STOCK” section ordered by the Customer are shipped within three business days to the address indicated in the order (to the building entrance) from the moment the payment for the order placed by the Customer is posted. Providing an incomplete or incorrect shipping address may delay or prevent order fulfillment, for which the Seller is not responsible. In exceptional situations, in consultation with the Customer and with their prior consent, the Seller may extend the order execution time by up to 14 business days.
  7. Delivery is organized by the Seller in one of the following ways:
    • courier shipment,
    • Seller’s means of transport,
    • personal pickup.
  8. Upon receiving the shipment, the Customer is obliged to check the condition of the shipment and its contents in the presence of the courier or the Seller’s employee. Checking the condition of the shipment and determining the nature of the violation or damage to the packaging in the presence of the courier, including preparing a damage report, will facilitate and expedite the Seller’s consideration of the complaint.
  9. The cost of shipping within Poland is calculated in the “Summary” in the Cart.
  10. The cost of shipping outside Poland will be determined with the Customer by phone or via email.

5. WARRANTY AND COMPLAINTS

  1. All goods offered in the Store are covered by the Seller’s warranty for physical and legal defects.
  2. In the event of detecting a defect in the goods, the Customer has the right to file a complaint using the form constituting Annex No. 1 to these Terms and Conditions, available on the website www.ewodd.com.
  3. Filing a complaint is done by filling out the complaint form (Annex No. 2 to the Terms and Conditions) and delivering it along with the complained goods and the note “Order Complaint” to the Seller’s address, or via email address: reklamacje@ewodd.com.
  4. After positive consideration of the complaint notification, the Seller provides the Customer via email with a position accepting or rejecting the complaint.
  5. The Customer should return the complained EWODD brand goods by postal shipment to the address:

  6. The complained goods should be properly secured for transport. The returned goods should be accompanied by proof of purchase with a description of the complaint and information about the bank account number to which the purchase amount is to be refunded after positive consideration of the complaint.
  7. The Customer should return the complained goods of brands other than EWODD by postal shipment to the address sent by the Seller to the email address provided by the Customer. After sending the shipment, the Customer is obliged to send the Seller the shipment tracking number via email address: reklamacje@ewodd.com The complained goods should be properly secured for transport.
  8. The Seller, immediately but no later than 14 days from the date of receiving the shipment with the complained goods, will respond to the filed complaint and inform the Customer about further proceedings. If the complaint is accepted, the damaged goods will be repaired or replaced with another, full-value item. If this is not possible, the Seller will refund the Customer the equivalent of the goods price. If the Seller does not respond to the Customer’s demands within 14 days, it means that they have considered the demands justified.
  9. The Seller refunds the costs associated with returning the complained goods in the amount of an economy shipment according to the current price list of Poczta Polska after positive consideration of the complaint or sends their own courier to collect the shipments.
  10. The Customer has the right to demand a price reduction or withdrawal from the contract, unless the Seller immediately and without undue inconvenience to the Customer replaces the defective product with one free from defects or removes the defect. This limitation does not apply if the product has already been replaced or repaired by the Seller or the Seller has not replaced the product with one free from defects, nor removed the defect.
  11. In the event of non-acceptance of the complaint, the Seller will return the goods to the Customer along with a written justification of the refusal decision regarding the complaint.
  12. Along with EWODD brand goods, the Customer receives a Warranty Card, according to which complaints will be accepted or rejected.

6. REFUND OF PAYMENTS

  1. In the event of circumstances obliging the Seller to refund payments made by the Customer to the Seller’s bank account, this refund will be made within a maximum of 14 business days.
  2. The refund is made to the bank account from which the payment was made. If, for reasons beyond the Seller’s control, identification of the bank account is impossible, the Seller will contact the Customer with a request sent to the email address provided during the order to confirm the bank account number for the purpose of refunding the payment.
  3. The Seller is not responsible for failure to make a refund or delay in the refund period if the Customer, despite a request sent to their email address, does not indicate the bank account number to which the payment is to be made or does not provide the Seller with all data necessary to make the payment. The Seller is not responsible for failure to make a refund or its delay if it occurred due to the Customer providing incorrect personal data (first name, last name, address) or an incorrect account number.
  4. A Customer purchasing goods for purposes related to professional or business activity (a Customer who is not a consumer) has the right to file a complaint in accordance with applicable legal provisions, whereby the Seller’s liability under warranty for physical defects of products is limited to the amount that the Customer paid to the Seller for the purchase of the given product.

7. TERMS AND CONDITIONS OF PARTICIPATION IN PROMOTIONS

  1. The promotion is valid for a period specified by the company in an announcement on the main page of the online Store.
  2. The promotion covers all or selected products from the Store.
  3. The promotion may cover ready-made products that are not subject to modifications.
  4. The discount amount is provided on the main page of the online Store.
  5. The promotion discount is included in the Store, i.e., the price displayed in the Store on the day the promotion is in effect is the price after the discount.
  6. Payment for the product during the promotion must be made during the promotion period. After this period, the promotional price is no longer valid and cannot be used as a basis for purchase.
  7. Promotions cannot be combined with others.
  8. Participation in the promotion means the participant’s consent to the promotion terms specified in these provisions.

8. RIGHT OF WITHDRAWAL FROM THE CONTRACT

  1. Due to the fact that all EWODD brand products available in the Store’s assortment are non-prefabricated products, manufactured according to the Customer’s specifications and serve to meet their individualized needs, within the meaning of the Act of May 30, 2014 on Consumer Rights as of January 28, 2020 (Journal of Laws of 2020, item 287) and the Act of April 23, 1964, the Civil Code as of August 2, 2023 (Journal of Laws of 2023, item 1610). The Customer does not have the right to withdraw from the contract without giving a reason within 14 days from the moment of delivery of the ordered goods.
  2. Products of brands other than EWODD and products in the “IN STOCK” section are ready-made products. In accordance with the provisions of the Act of May 30, 2014 on Consumer Rights as of January 28, 2020 (Journal of Laws of 2020, item 287) and the Act of April 23, 1964, the Civil Code as of August 2, 2023 (Journal of Laws of 2023, item 1610), every Customer who purchased a Product in the Store as a consumer within the meaning of the provisions of the Civil Code may, within 14 days, withdraw from the Product Sales Agreement on the terms and in the manner specified in the information constituting Annex No. 2 to the Terms and Conditions.
    1. To exercise the right of withdrawal from the Sales Agreement, you must fill out the Withdrawal from Sales Agreement form, Annex No. 2 to the Terms and Conditions. Withdrawal from the contract can also be made by submitting a statement to the address reklamacje reklamacje@ewodd.com.
    2. The Seller requests that along with the Product returned in connection with withdrawal from the Sales Agreement, the Customer send a copy or original of the proof of purchase.
    3. The Seller, within 14 business days after receiving the shipment from the Customer, will refund the payment for the product not including the shipping costs incurred by the Customer. Only the costs incurred for the purchased product will be refunded.
    4. The Customer returns the product at their own expense by courier to the address indicated by the Seller. Upon sending the packages, the Customer is obliged to send the waybill numbers to the address: reklamacje@ewodd.com.


9. FINAL PROVISIONS

  1. The sales contract is concluded between the Customer and the Seller.
  2. EWODD brand goods presented on the Store’s pages do not constitute an offer within the meaning of the Civil Code. Information about goods posted on the Store’s pages does not mean that the goods are available in the Store’s warehouse, as all goods are made to the Customer’s individual order.
  3. Goods of brands other than EWODD are available in stock or on order. This information is provided for each product in the store.
  4. Goods in the “IN STOCK” section are available in the Store’s warehouse.
  5. The Store is not responsible for blocking by mail server administrators the sending of messages to the email address indicated by the person using the Store, nor for deleting and blocking email messages by software installed on the computer used by the Customer.
  6. Any disputes arising from the implementation of the provisions of these Terms and Conditions will be attempted by the parties to be settled first through agreement. Subsequently, they will be submitted to the resolution of the competent court in accordance with the Code of Civil Procedure of November 17, 1964 (Journal of Laws No. 43, item 296, as amended). A Customer who is a consumer has the option to use an out-of-court method of considering complaints and pursuing claims before the Permanent Consumer Arbitration Court at the Provincial Inspector of the Trade Inspection in Warsaw. Information on how to access the aforementioned procedure and dispute resolution procedures can be found at the following address: www.uokik.gov.pl, in the “Consumer Dispute Resolution” section.
  7. In matters not regulated in these Terms and Conditions, the provisions of Polish law apply, the Act of May 30, 2014 on Consumer Rights as of January 28, 2020 (Journal of Laws of 2020, item 287) and the Act of April 23, 1964, the Civil Code as of August 2, 2023 (Journal of Laws of 2023, item 1610).
  8. These Terms and Conditions are available at the electronic address www.ewodd.com in electronic version, enabling its acquisition, reproduction, and recording using the ICT system used by the Customer.
  9. These Terms and Conditions are effective from December 18, 2023.
  10. The Seller may change the Terms and Conditions and launch a new version of services provided within the Store. The change becomes effective on the date indicated by the Seller, which cannot be shorter than 14 days from the moment the changed Terms and Conditions are made available in the Store, with the proviso that orders started before the changes take effect are conducted under the previous terms.
  11. The Customer will be informed of changes to the Terms and Conditions by email no later than 14 calendar days before the introduction of the changed Terms and Conditions. If the Customer does not accept the new content of the Terms and Conditions, they are obliged to notify the Seller of this fact within 14 days from the date of notification of the change to the Terms and Conditions. Refusal to accept the changes is equivalent to termination of the contract with the Seller.
